Americans with Disabilites Act Policy
CITY OF BOONVILLE, MISSOURI
AMERICANS WITH DISABILITIES ACT POLICY STATEMENT
APPROVED JANUARY 7, 2008 CITY COUNCIL MEETING

In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 ("ADA"), the City of Boonville, Missouri ("City") will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs and activities.

The City will continually strive to make the programs, services and activities of the local government and sponsored by the City accessible to all citizens including those with a physical, mental or communication disability or limitation. The City will evaluate ADA accessibility and accommodations in funding priorities and preferences.

The City has appointed an ADA Coordinator whose duties include assessment, investigation and reporting of ADA compliance and presenting aids and services to improve accessibility to citizens of Boonville. The ADA Coordinator is the Director of Parks and Recreation. His contact information is:

The City has established an ADA workgroup consisting of the ADA Coordinator, City Clerk and City Counselor to review and recommend policies and procedures, conduct assessments and assist the Council, Mayor, Administrator and Coordinator with meeting the goals of the Act. This group will meet at least quarterly at City Hall.

The ADA Coordinator will provide the City Administrator, Mayor and City Council with a Semi-annual Compliance Report reviewing the activities and recommendations of the Coordinator, Workgroup, Employees and Citizens.

The City will conduct an annual Public Forum in January at City Hall to solicit input from the public, business community, emergency and health care professionals on issues regarding accessibility, notices, policies and procedures, budget recommendations and other issues of import regarding compliance with the Act and assisting the disabled citizens of Boonville to fully participate in local government and in responding in the event of a community emergency.

The City will publish semi-annually (January and July) a notice to the public via the Boonville Daily News and KWRT Radio Station on the person to contact for any questions or concerns regarding access to local government services, programs, meetings or activities, and complaints.

The ADA Coordinator will be responsible to maintain and update the City website with all ADA information. The Boonville website is located at www.boonville-mo.org

The ADA Coordinator will be responsible to maintain and update a list of all city property with the available signage, devices, equipment and aids to assist disabled citizens at each location.

The ADA Coordinator will work with the Cooper County Emergency Management Director and other emergency responders and services to identify community members at risk and establish protocols and safeguards in the event of a community disaster or power outage.

Notice Under the Americans With Disabilities Act
In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 ("ADA"), the City of Boonville will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.

Employment: The City of Boonville does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.

Effective Communication: The City of Boonville will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the City of Boonville’s programs, services and activities, including making information and communications accessible to people who have speech, hearing or vision impairments.

Modifications to Policies and Procedures: The City of Boonville will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services and activities. For example, individuals with service animals are welcomed in the City of Boonville offices, even where pets are generally prohibited.

Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service or activity of the City of Boonville, should contact the office of Gary Nauman, ADA Coordinator, at 660-882-7447 as soon as possible but no later than 48 hours before the scheduled event.
The ADA does not require the City of Boonville to take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden.

Complaints that a program, service or activity of the City of Boonville is not accessible to persons with disabilities should be directed to Gary Nauman, ADA Coordinator, Parks and Recreation Dept, 1221 Eleventh St., Boonville, MO 65233, or gary.nauman@boonville-mo.org.

The City of Boonville will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

City of Boonville Grievance Procedure Under The Americans With Disabilities Act
This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 ("ADA"). It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability the provision of services, activities, programs or benefits by the City of Boonville.

The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon request.

The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, Gary Nauman or his designee will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, Gary Nauman or his designee will respond in writing and where appropriate, in a format accessible to complainant. The response will explain the position of the City of Boonville and offer options for substantive resolution of the complaint.

If the response by Gary Nauman or his designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 15 calendar days after receipt of the response to the City Administrator or his/her designee.

Within 15 calendar days after receipt of the appeal, the City Administrator or his/her designee will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the City Administrator or his/her designee will respond in writing and where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

All written or formally communicated complaints received by Gary Nauman or his designee, appeals to the City Administrator or his/her designee, and responses from these two offices will be retained by the City of Boonville for at least three years in the office of the City Clerk.

Boonville is centrally located in the state and close to a variety of great areas for exploring and visiting. Boonville also has great resources right in town, including several churches, social services, a regional library, and a local newspaper and radio station.

KATY Flyer
Boonville recently added local public transportation. It is available on Tuesdays, Wednesdays, and Thursday from 7:30 AM to 5:00 PM. The cost is $2.00 one way. Reservations are required and should be made one day in advance, 660-882- 2366.

Boonslick Regional Library

State Parks and Recreation

In addition to the 12 parks in Boonville, there is a variety of other recreational opportunities.

The Katy Trail-
www.bikekatytrail.com is the longest rails to trails program in the country, stretching 225 miles from St. Charles to Clinton, MO. The trail is flat and scenic, perfect for hikers, runners, and bikers.

Arrow Rock- The Village of Arrow Rock is on the National Historic Register and provides visitors an opportunity to step back to the 1860’s. The village has parks for hiking, a theatre, and visitors can tour the village. For more information, visit

YMCA- Boonville is home to the Boonslick Heartland YMCA. The YMCA has a pool, exercise equipment, indoor courts and outdoor fields. For more information, visit,

Columbia, just twenty minutes from Boonville is home to the University of Missouri and a great opportunity to catch collegiate athletic games and matches.

Rockbridge State Park is an opportunity to get away from the city and hike, bike, and ride in over 2000 acres. Additionally, the Park offers advanced and beginning cave tours.
